These Website Terms of Service apply to the website with a home page located at www.AppleFreebiez.com ("AppleFreebiez"). By using this Website or creating an Account you agreeing to these Terms of Service. Any violation of these Terms and services may lead to account disqualification, forfeiture of earnings and any applicable legal remedy. All visitors and users of this site are referred to as "User," "Users," "you" or similar terms. Third party companies are referred to as "Advertisers." This legal document appears in English only.

This Website is owned and operated by InstantDollarz Incorporated ("InstantDollarz," "AppleFreebiez," "us," "we" or similar terms), located at PO Box 17257, Philadelphia, PA 19105. All inquiries should be directed to that address, or to support@AppleFreebiez. We reserve the right to update these Terms and Services at any time. Such changes are effective once posted on this page.

MEMBERSHIP

Terms of Membership.

1. Must be 18 years of age or older, or 13 years of age or older with parental permission.
2. Must provide valid and truthful information at all stages of membership at AppleFreebiez.
3. Must be from the United States of America, Canada, the United Kingdom (including Great Britain, Ireland and Scotland), Germany, France and Belgium.
4. May not create more than one account per person, household or computer, unless granted written permission.
5. May not utilize a proxy or other method of hiding location.

Terms of Disqualification. Account may be deactivated and earnings forfeited if, at AppleFreebiez's discretion:

1. User violates any of these Terms of Service.
2. User completes offers "on behalf" of another user.
3. User attempts to sell, transfer or exchange their account or credits on their account to other persons.
4. User attempts to exploit system vulnerabilities (hacking).
5. User commits actions that AppleFreebiez determines to be detrimental to the stability of this site or this site's relationship with advertisers.
6. User posts a walkthrough or guide to completing or cancelling offers or any other suggestion to take undue advantage of any advertiser, on a public website or forum or privately to their referrals.
7. User attempts referral promotion using explicit, vulgar or obscene language; hate-mongering and other objectionable content; pornographic images or speech, phone sex and escort services, or nudity; infringements on any property rights or copyrights, including distribution of "warez" through file-sharing networks; gratuitous violence or profanity; or contains threats of physical harm to anyone; software pirating, hacking or phreaking; promotion of investment or money-making opportunities not permitted under law. promotion of illegal substances and activities; promotion with deceptive or misleading practices, such as phishing or spyware; or using libelous, defamatory, false, misleading or infringing statements; or promotions that may violate third party terms and conditions, including unauthorized use of a third party website for commercial gain or posting bulletins on non-owned accounts (spamming).

Deactivation and Reactivation of Membership.

1. Account deactivation may be managed through user accounts.
2. Upon deactivation, all credits are forfeited and cashout requests removed.
3. Accounts may be reactivated at any time.
4. If inactive for 12 months, accounts will automatically deactivate.

Signup Bonus. To qualify for the Signup Bonus, users must:

1. Have a valid email and mailing address.
2. Complete their user profile.
3. Maintain all membership requirements through their first cashout.

Username and Password.

1. Each user has a unique Username. Users are responsible for keeping their Username and Password confidential and secure, and are responsible for all actions taken on their account using their Username and Password.

Representations of Membership. You agree:

1. That all information you have provided to AppleFreebiez and to other entities during your usage of the AppleFreebiez service and website is accurate and current.
2. That you have the full authority and rights to use such information to perform all acts required of you during usage of this service, in compliance with local/national/international law.
3. To these Terms of Services, and all terms and conditions of the Privacy Policy as a condition to using AppleFreebiez, including any updates which may occur at the sole discretion of AppleFreebiez. All updates will be posted on this website. Failure of AppleFreebiez to enforce these terms do not constitute a waiver.
4. That you are responsible for all consequences of your actions on this site.
5. That You and AppleFreebiez are independent contractors as to one another. You are not AppleFreebiez's agent, partner, franchise or employee for any purpose and shall not hold yourself out as AppleFreebiez's agent, partner, franchise or employee.

Referrals

Conditions.

1. A "Referral" is considered to be any user that signs up successfully using another user's referral link.
2. Must be unique persons that have not been signed up on their behalf by others.
3. Must meet all terms of membership at all times.
4. Users are responsible for the overall quality of their referrals.
5. Falsification of referrals may lead to account disqualification, forfeiture of earnings and any applicable legal remedy.
6. False advertising, including making untrue or exaggerated statements about AppleFreebiez's service, is forbidden. If the user provides any information about our service on their website, the information must be updated and accurate.

Terms of Referral Earnings.

1. Referral rewards are earned once referrals reach site minimums and cash out successfully.
2. All rewards are posted automatically.
3. Minimum reward is 10% of the referral's earnings for first level referrals

Offers

Conditions of Credit.

1. AppleFreebiez is solely responsible for crediting of offers, and reserves the right to adjust offer descriptions and commission rates at any time for any reason. Do not contact advertisers regarding offer credit.
2. User may only complete an offer if they have never completed the offer before or been a customer of the advertiser previously, whether through AppleFreebiez or other means.
3. Users must provide valid and truthful information in order to complete offers. Any falsification of user information will lead to account disqualification, earnings forfeiture and any applicable legal remedy.
4. Users must have a legitimate interest in offers they complete. Users will be penalized if found to be violating this provision, under AppleFreebiez's sole discretion. AppleFreebiez considers high levels of cancellation to be evidence that a user does not have a legitimate interest in the offers.

Conditions of Manual Credit.

1. Though AppleFreebiez utilizes industry standard tracking software, offers may occasionally fail to credit. AppleFreebiez does not guarantee payment for any offers that fail to credit, or for manual credit requests that have been submitted.
2. If an offer fails to credit, users may request manual credit through the support ticket system. A valid confirmation email must be provided for the offer in question. If possible, AppleFreebiez will work with users and advertisers to querty these missing credits.
3. Manual credit requests may take several weeks to be confirmed.

Liabilities.

1. AppleFreebiez cannot be held responsible for the terms, conditions, or any other contractual agreement of the offers listed on the site. We suggest that all items associated with each offer be read, completely and carefully, before offer completion. All decisions to purchase products and services, sign up for trials and exchange money for whatever purposes are your sole responsbility, and AppleFreebiez cannot be held responsible for any of your actions committed on other sites.
2. AppleFreebiez shall not be held liable at any time for any other results stemming from use of your account, including, but not limited to, termination and suspension of customer accounts and profiles elsewhere, information dissemination, litigation and its costs and consequences, and any other consequences of every kind and nature.
3. Advertisers may change the Terms of an offer without notifying us. In such an event, AppleFreebiez makes no guarantee on the accuracy of the offer descriptions listed.
4. AppleFreebiez is not responsible for any additional incentives provided on offers, such as gift cards, free gas, etc. Any inquiries regarding these additional incentives should be directed to the Advertisers.
5. AppleFreebiez shall not be held liable at any time for any results stemming from usage of tools provided by the site that allow users to send invitation or referral emails and messages to their email and social network contacts. Since users are technically utilizing their own email and social network accounts to send any messages, they are solely responsible for any consequences of utilizing that service.

Disbursements

Account.

1. Points earned for successfuly completing offers will accrue in a User's balance, subject to the User's compliance with these Terms of Service. The User's account and balance is non-transferable and non-assignable.
2. If the User have been credited for an offer and the offer is later reversed, the corresponding amount will be subtracted from the their balance.

Conditions of Disbursement.

1. AppleFreebiez is solely responsible for all disbursements. Do not contact advertisers regarding disbursements.
2. Disbursements occur on or around the 20th of each month for the previous month's cashouts.
3. Users are responsible for redeeming their cashouts. Cashouts may only be redeemed if the cashout minimum for the user's chosen prize is achieved and the user has not violated any of these terms of services. Balances not cashed out will rollover into the next month. Users have no absolute right to redeem the balance in their account, and we have no liability or obligation to pay you until you have accrued the cashout minimum. Your balance will be reduced by the value of the payment, whenever a payment is successfully made.
4. No payment substitutions, assignments or transfers will be considered, except by AppleFreebiez. AppleFreebiez will make a reasonable effort to alert users if a substitution will be made.
5. Users are responsible for maintaining correct payment information. AppleFreebiez is not responsible for any lost or stolen mailings or payments if the communication was sent to the Account information on file at the time the mailing or payment was sent.

Specific Conditions.

1. Users earning prizes and/or gifts worth over $600 during a calendar year must submit a completed W-9 form to AppleFreebiez before payments may continue.
2. Users are responsible for any and all tax liability arising from or associated with their use of AppleFreebiez, including any liabilities arising from their earnings on this site.

General Terms

Copyrights and Trademarks.

1. All content, materials, images and other items ("Materials") accessed through this website belong to AppleFreebiez, its third party licensors or third part Advertisers. Users may download or print one copy of the Materials for personal, non-commercial use, with inclusion of all copyright notices.
2. The Materials are protected by United States and foreign copyright laws. Any commercial usage of these Materials is in violation of those laws and are punsihable as such. In such a case, AppleFreebiez revokes the User's right to use the Materials and all copies in the User's possession should be destroyed. All right, title and interest to the Materials remains with AppleFreebiez. All rights not expressly granted are reserved.
3. Any communications with AppleFreebiez or on the forums by any means will be considered non-personal, non-confidential and non-proprietary. You hereby grant AppleFreebiez and any sublicensees perpetual, worldwide, royalty-free, unrestricted, irrevocable license to use, reproduce, display, perform, modify, create derivative or collective works, transmit and distribute these Postings and Messages, and agree that AppleFreebiez is free to use such Postings and Messages for any purpose and in any medium.
4. If any posting on the website is in violation of copyright or some other proprietary right of a third party, please notify us immediately. Specific identification of the offending materials and identification of the true owner is required so that we may take appropriate action.

Representations.

1. The AppleFreebiez website and offers exist on an as is and an as available basis. AppleFreebiez claims no responsibility or liability for the reliability of the service, including timeliness, availability or security. Additionally, AppleFreebiez reserves the right to make any changes to the status and content of the service or website for whatever reason at any time, with or without notice, and without any liability to AppleFreebiez.
2. At no time shall AppleFreebiez have a commitment toward any user. AppleFreebiez may terminate the service for any or all users at its discretion, for any or no reason, at any time, without any notice. AppleFreebiez shall remain in a state of non-committance after termination of the service. AppleFreebiez also retains the right to discontinue the Service and remain without commitment toward any past user from any previous period or periods of Service availability or suspension. In the event that AppleFreebiez discontinues their service, users will have 30 (THIRTY) days in which to redeem their balance.
3. AppleFreebiez takes no responsibility for any content on other sites, including viruses, spyware, or other disabling features. AppleFreebiez has no responsibility or obligation to monitor such content. AppleFreebiez reserves the right to distribute or withhold information on such content - and its own content - at AppleFreebiez's sole discretion.
4. AppleFreebiez reserves the right to deny payments for any legitimate reason and to report fraudulent activities to the proper authorities. AppleFreebiez also retains the right to send periodic update emails, completion update emails or information about related services, all of which will be strictly controlled and in accordance with CAN-SPAM laws.
5. All disputes under this agreement must be settled under the laws of Delaware. Any litigation relating to this document must be brought in the federal and state courts located in Delaware.

Indemnification and Severability.

1. You agree to hold harmless and indemnify AppleFreebiez, its affiliates, agents and all members from and against any third party claim arising from or in any way related to your use of the Service, including, but not limited to, any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature.
2. In no event shall AppleFreebiez, a Delaware Corporation, be liable for any indirect, consequential, incidental, special, punitive or other damages whasoever (including, without limitation, damages for loss of business profits, business interruption or loss of business information), arising out of or in connection with the availability, performance or use of the information contained on this website, even if AppleFreebiez has been advised of the possibilites of such damages.
3. If any part of the Terms is found to be invalid, illegal, void or otherwise unenforceable, that decision shall not affect the remaining provisions within this document. These shall remain valid and enforced. Headings used within this document are for convenience and shall not be used to construe any claims against any of the provisions within these Terms.
